Victoria – 60 square metres

They are called a “Dependant Persons Unit” (DPU), so they must be movable. Similarly to Queensland, the regulations vary in size depending on your Council. See detailed VIC rules.

New South Wales – From 60 square metres – 100 square metres. 

The former is a Complying Development, and the latter must be approved by submitting a Development Application. See Detailed NSW rules.

South Australia – 60 square metres 

OR 70% of the total floor area of the primary dwelling (whichever is less). See detailed SA rules.

Tasmania – 60 square metres 

OR 30% of the total area of the main home (the lesser). See detailed TAS rules.

Western Australia – From 70 square metres – 100 square metres depending on your local Council. Rural areas are more likely to be flexible. See detailed WA rules.

Northern Territory 

Metropolitan areas, such as the city of Darwin, have more strict limits, with the floor space limited to 50 square metres. But, again, rural regions are possibly more lenient. For example, your local Council may allow up to 80 square metres.

Australian Capital Territory – 90 square metres.

How to Choose a Granny Flat Builder?

Ask the granny flat company if they are a licensed builder and request their license number. You can then also do a free licence check on the Fair Trading website.

Ask for references and a list of completed projects. Where possible, ask if you can walk through a completed granny flat to check the quality.

Check that the granny flat company knows about all the rules in the NSW Legislation enabling granny flats to be built via a Complying Development Certificate (CDC)?

• Do they know a minimum block width of 12m, not just that the block must be more than 450sqm?
• Do they know three different boundary offset requirements are depending on the size of the block?

If they do not know answers to these questions, they are most likely not experienced granny flat builders.

Make sure the company’s website is professional and informative. If they do not have a professional website or all the information you need about their company, you need to ask yourself if they will be experienced when it comes time to build.

Check the inclusions in the quote. Make sure you always compare “apples for apples” when examining different companies’ quotes. For example, some companies will only quote the bare basics and leave out things such as essential service connections to make their quote look cheap compared to their competitors. 

Sometimes when you thoroughly assess the lowest price and obtain costs for the “gaps”, you find the companies’ final price can be higher than the other companies that had everything included in the first place.

How long will it take to build the granny flat?

Do I have to go through Council to get my granny flat approved?

Can my granny flat be attached to the existing house?

Yes, however, there must be a fire-rated wall to separate the house and the granny flat since they are two separate dwellings. This will generally be more expensive than building a detached granny flat.

If I have a battle-axe block, can I still build a granny flat?

Yes, however, the driveway access must be minimum of 3m wide, and the block must have minimum dimensions of 12m x 12m.

Can I build two granny flats on my block?

No. Only one granny flat is allowed to be built. The State Environmental Planning Policy (SEPP) allows only one primary dwelling and one secondary dwelling per lot.
